The law of patentable subject matter under the Supreme Court’s Alice and Mayo decisions has been a moving target, often frustrating to understand and apply.  Recent Section 101 decisions by the Federal Circuit – including EnFishBascomCellzDirectMcRo, and Amdocs – have provided some more specific guidance, shaping the contours of subject matter eligibility.  We will discuss these recent decisions and related Patent Office recommendations, with an eye to how the Court’s apparent course affects both patent prosecution and litigation strategies.
