In 1998, the Digital Millennium Copyright Act (DMCA) amended U.S. copyright law to limit the liability of online service providers (OSPs) for copyright infringement by their users. The DMCA creates a safe harbor for an OSP that follows prescribed guidelines for blocking access to allegedly infringing material after receiving proper notification of a copyright infringement claim (a “takedown” notice). Although more than 15 years have passed since the law took effect, questions and controversies surround the proper use and/or the abuse of the DMCA takedown process. The speakers will explore DMCA issues from both the copyright holder and the OSP perspective, and will discuss recent developments in the DMCA-related cases pending in the Ninth Circuit (
Lenz v. Universal Music Corp.
) and the Second Circuit (
Capitol Records, LLC v. Vimeo, LLC
).
