6:30 - 8:00  PM Panel Discussion

Pillsbury 2550 Hanover St., Palo Alto

In 1998, the Digital Millennium Copyright Act (DMCA) amended U.S. copyright law to limit the liability of online service providers (OSPs) for copyright infringement by their users.  The DMCA creates a safe harbor for an OSP that follows prescribed guidelines for blocking access to allegedly infringing material after receiving proper notification of a copyright infringement claim (a “takedown” notice).   Although more than 15 years have passed since the law took effect, questions and controversies surround the proper use and/or the abuse of the DMCA takedown process.  The speakers will explore DMCA issues from both the copyright holder and the OSP perspective, and will discuss recent developments in the DMCA-related cases pending in the Ninth Circuit (Lenz v. Universal Music Corp.) and the Second Circuit (Capitol Records, LLC v. Vimeo, LLC).
