at Ropes & Gray’s Silicon Valley offices to explore the roles that IP attorneys should, and are, playing in the information age.
Companies continue to rely more and more on large data sets to conduct business. They either directly collect vast amounts of information or acquire information from other sources. This data is then analyzed and the results exploited through various channels.
Do IP attorneys have a role in this process? A traditionalist might say no as there is no cognizable “data right” in the U.S. But is that really true? After all, isn’t part of an IP attorney’s role to define, protect and monetize ideas? Can this definition be expanded to include the IP attorney who really understands how to build and manage businesses based on creating and monetizing intangible rights?
